Supreme Court Orders Abercrombie to Pay Up

$72M Vanishes: New Council on Revenues Forecast Minus 1.8%

Poll: Ige 51 - 41 over Abercrombie

CB: With barely a week to go before the primary election, state Sen. David Ige has a double-digit lead over Gov. Neil Abercrombie in the race for the Democratic gubernatorial nomination, a new Civil beat Poll shows.

A majority of Hawaii voters surveyed statewide, or 51 percent, who say they will vote in the Democratic primary said they would vote for Ige, compared with 41 percent for Abercrombie. Just 8 percent said they are undecided.

Poll: Schatz 49-41 over Hanabusa

CB: The survey of likely Democratic voters shows Schatz with a 49 percent to 41 percent edge on Hanabusa. That’s a wider lead then in May, the last time Civil Beat polled the race....

The poll shows 30 percent of participants going for Takai with 23 percent choosing Kim. For Takai that’s a 6 point jump from Civil Beat’s last CD1 poll in May. For Kim, that’s a 7 point slide.

Honolulu City Councilman Stanley Chang is in third with 15 percent, ....

Borreca: The Schatz-Hanabusa race is maddingly hard to decipher; and the 1st Congressional District race is going largely unnoticed.

Schatz, Tsutsui Scrape the Abercrombie off of themselves

RC: The careers of Hawaii Sen. Brian Schatz and Gov. Neil Abercrombie have been linked for several years, but the Schatz campaign has worked for the past 18 months to ensure their political fates are not.

With the Aloha State Democratic primaries just a week away, it’s increasingly possible Schatz, the former lieutenant governor appointed by Abercrombie in December 2012, could win the Senate nomination, even as the governor loses his own re-nomination....

That was clear in the final debate this month, when Schatz was asked directly about his website’s omission of any signs of Abercrombie....

Hanabusa: I am What Makes Hawaii Unique

HI-SEN (SCHATZ): Rep. Colleen Hanabusa (D-Hawaii) warns that she worries that “Hawaii is becoming more and more like everywhere else and less like the place we’ve always loved,” touting the state’s “pride in our traditions” in a new ad. She’s sought to paint appointed Sen. Brian Schatz (D-Hawaii) as too mainland, though he also grew up in the state. Schatz’s campaign has spent almost $5 million on the race.

GOP Fundrace: Ahu vs Sutton

On the Republican side, Elwin Ahu, New Hope-Metro pastor, raised $62,000, more than double the amount of the only other GOP challenger, entrepreneur Kimo Sutton, who pulled in $25,000.

Ahu has $131,000 for the year with $30,000 on hand and no debt heading into the final weeks of the campaign.

Sutton has raised a total of $42,000 for his bid and still has $18,000 remaining but carries $23,000 in campaign debt.

Super PACS Push Council Candidates

SA: Candidates in two Honolulu City Council races are complaining about large sums of money being spent to defeat them by independent expenditure committees, also known as "super PACs," that are not limited by traditional campaign laws.

AiKea UniteHere, established and funded by the UniteHereLocal 5 PAC Fund and Unite HereTIPState and Local, spent $159,249 from Jan. 1 to July 25 to support the campaign of hotel employee and temporary Local 5 employee Joli Tokusato in her effort to defeat incumbent Carol Fukunaga, Sam Aiona and Steve Miller.

Forward Progress, established and funded by the Hawaii Carpenters Market Recovery Program Fund, which also does business as the Pacific Resource Partnership, has disbursed $232,307 in support of five candidates, including Honolulu City Council candidate Brandon Elefante.

Russ Grunch, one of Elefante's three opponents, questioned the amount being spent to support Elefante's campaign by a group about which little is known.

'Drama and Trauma' at UH Manoa--Lassner Prepares to Name New Chancellor

KITV: The head of the Center for Educational Policy expressed disappointment that the university  had not yet turned the corner of what he called, "drama and trauma."

"There has to be a discussion about the real policy issues. This is issue about firing a chancellor. This is not a private matter. It's a public matter. You can't say it's none of your business," said Jim Shon.

Shon was on hand at the regents meeting two weeks ago, and had urged UH officials to hold a summit about  the university’s  future admist growing economic pressures and legislative underfunding.

Apple's settlement will include being paid $100,000 for attorney’s fees and flexibility to look for a job elsewhere.

He had offered to waive the legal fees if he could remain on the job.

UH said no.

When Apple steps down at the end of the month, he will prepare to be back in the classroom next spring at a salary of about $300,000 a year.

He will report to the chemistry department, not the medical school,

expressing concerns with about working under current dean Jerris Hedges.

Apple cut the medical school budget by a million dollars last year.

Meanwhile Lassner expects to name an interim chancellor in time for next month's board of regents meeting.

Rep. Cabanilla: ‘I Need to Eat Too’

CB: It says so right in her most recent campaign expense report, filed Wednesday with the Hawaii Campaign Spending Commission.

Cabanilla spent $31.65, July 8, at Pueo’s Restaurant in Ewa Beach. Sole reason provided for the mixed-benefit expense? “I need to eat too.”

In all, she spent $2,033 during the reporting period, which covers July 1 to July 25. Much of that was food, including $264 for a fundraiser at Seven Palms Bar in Honolulu, and postage for campaign fliers.

CB: Cachola spent $9,194 on “food and beverages”

MBloom: Self-Dealing Hi-Tech Schemers Sued for Stealing Code

CB: Weary of Mbloom’s self-funding, many community members dug into Kryeziu’s past.

A cursory Google search yields — pardon the pun — curious fruit: Kryeziu’s project in 2004, CherryOS, a piece of software owned by Maui X Stream and built by Kryeziu, has been proven to contain extensive amounts of code stolen from PearPC, an open source project licensed under GNU GPL. Both CherryOS and PearPC were early PowerPC G4 processor emulators for Microsoft Windows....

Kryeziu pointed to his blog post about the mishap where he admits, “I recruited help from an offshore company to meet tight deadlines. It was discovered after the release to have GPL code within it.”

...Kryeziu initially told Wired that he wrote the code for CherryOS himself in four months....

Later, after controversy struck, Kryeziu pinned the blame on an employee of Maui X Stream:

Only later did he point the blame at an outsourced company, presumed to be India-based company Comsdev....

In a blogpost written by Micheal Bell (the blog post is no longer published but available via PDF from docstoc), Elance records prove Kryeziu hired Comsdev in April of 2004, which would fit with the four-month build period Kryeziu initially attributed to himself.

... in 2004, both CherryOS and PDFConv (initially called Mbloom PDFConv) were available for download from the mbloom.com domain. Only later was CherryOS removed from mbloom.com and attributed to Maui X Stream.

Prior to the town hall, I was able to review the full history of mbloom.com from the Internet Archive. The domain has since started blocking all archive requests.

When asked, Kryeziu said he “put the content on (mbloom) as a placeholder. And when I resigned from the company in 2005, I made sure to take the mbloom domain back because I wanted to reuse it in the future.”

PDFConv also sparked controversy after its release. According to Michael Bell, a significant amount of code was stolen from PDF2HTML, another product licensed under GNU GPL. From Bell’s blogpost:

“Ryan Thoryk…ran a DIFF between the source of PDFConv and PDF2HTML (where you take two files, or sets of files, and compare them together so you can see what the differences are) and it became obvious Arben had simply stripped out the original copyright notices within verypdf.com’s code and posted it as his own.”

In 2011, Aqua Connect filed a claim against Krezyiu’s company, Code Rebel, stating that Vladimir Bickov and Krezyiu downloaded a trial version of Aqua Connect’s Terminal Server software, reverse engineered it in violation of the End User License Agreement, and reused the code in Code Rebel’s iRAPP Terminal Server....

It’s worth noting that Code Rebel was also reviewed by Mbloom’s LP committee for a potential investment opportunity, but the LP committee declined  to invest....

Matayoshi: DOE focuses its spending at school and student levels

PBN: Last year, the Hawaii State Department of Education implemented the Hawaii Common Core — a set of clear and consistent standards, or learning goals, defining what students need to master at each grade to graduate prepared for life after graduation. The Hawaii Common Core is aligned with college and work-force expectations and grounded on real-world application of essential knowledge and skills.

The success of educational programs would not be possible without the strong support of business and community partners such as Castle Foundation, Kamehameha Schools, Hawaii P-20, Hawaii Business Roundtable, James Campbell Company, McInerny Foundation, The Learning Coalition, Hawaii Community Foundation, and many, many more.

(Attention candidates: With Abercrombie pau, who will be the champion of P-20?)

These partners understand the need for more rigorous standards and are helping us reach our student achievement goals. They know the DOE cannot do it alone and that supporting our educators and students is a rewarding investment that benefits all of Hawaii.

Escaped Prisoners Risk 5 year Sentence

SA: In January 2013, OCCC doubled the size of its work-furlough program, to 216 from 96 beds. The number of walkaways predictably spiked, from 16 in 2012 to 26 in 2013. So far in 2014, 30 inmates have walked away — and that's only seven months into 2014. All but two were back in custody as of Thursday....

The errant inmates risk adding a maximum five years to their sentences for failing to return to the furlough program, which counts as a prison escape.

"They're so close to freedom," Sakai said. "It's a shame to see them toss it all aside, because of an impulsive act."

(No.  It is good to catch the impulsive criminals and lock them up for another 5 years.)
