Alleged Waikiki Road Rage Assault -- Former Prosecutor Gets Free Pass for Husband

BJ: … What apparently began as a pedestrian-motorist road rage incident on Kapahulu Avenue in Waikiki exploded in violence last Sunday in the lobby of the Waikiki Grand Hotel, with one person suffering a serious head injury, another arrested for assault but then released without charges. It’s an odd case, all the elements considered.

The principals: Joel Bean, a Waikiki Grand resident and computer technician; Rolf Nordahl, also a hotel resident, owner of MacMouse and Bean’s employer; Jason Nohea Owens, a 2000 Punahou graduate listed in Linked In as a property manager but said to work at Pearl Harbor; and Marissa Lum Owens, a 2002 Punahou graduate, former deputy city prosecutor and current associate counsel at HEI, Inc.

The case is #21-420310-002 at the Honolulu Police Department.

It began late afternoon Oct. 3, as Joel Bean was in the Kapahulu crosswalk by the hotel, pulling a wagon with two grandchildren in it and a third holding his hand. A car entered the crosswalk barely ahead of him, then stopped in the crosswalk because of backed up traffic. Bean says he rapped on the car’s side. He says the driver angrily shouted something about “Haole. I didn’t hear ‘fucking’ as some have said. Go back to the mainland.”…

The driver, Jason Owens,  parked his car and ran after Bean into the hotel lobby allegedly. Bean’s statement says “He blocked the elevator, preventing it from closing and stated yelling ‘call the police. Something about damaging his vehicle.”

But Bean closed the door and witnesses say Owens began kicking the elevator door. His wife, Marissa Owens, was also in the lobby at that time.

Coincidentally, Rolf Nordahl arrived in the lobby from a dog walk and tried to talk Owens into stopping his kicking of the elevator door and calming down. He says Marissa Owens began yelling at him to leave her husband alone. Nordahl says he turned and told her to “shut up.”  That’s when, he says, Jason Owens grabbed him and slammed his head against the lobby reception counter. Police arrived because of a hotel employee’s call.

Nordahl suffered scalp and knee cuts, was taken by ambulance to the hospital, and has undergone two brain scans. Police arrested Owens on suspicion of 2nd degree assault. The elevator was shut down until a maintenance man could repair the malfunctioning door.….

But HPD is not charging Owens and released him from custody “after consultation with the prosecutor’s office.”  Marissa Owens is not yet filing against Nordahl. Nordahl said in an email yesterday “I guess it helps to have connections.”

HNN: … something went wrong after Haynes got out of the Army where he served in Afghanistan. About four years ago, he told his family on the mainland he was moving to Hawaii, then all communication suddenly stopped….

Haynes camps near a service station on Vineyard Boulevard. Solie said he’s been there for months, if not years.

…Haynes was from Toledo, Ohio. 

“My girlfriend went on Facebook and got hold of the administrator of a missing person’s site on Facebook in Toledo, Ohio. Within 20 minutes someone types on there, ‘That’s my little brother!’” Solie said….

“We got on a plane, flew down there, tried to get him to come on back. He wasn’t willing to do that. He’s just not right mentally. If I could have gotten him on a plane, trust me I would have,” Moses said, from his home in Arizona.

He believes his brother is suffering from PTSD and other issues, and the family isn’t giving up. With help from the Institute for Human Services, they’re now working on getting guardianship of Haynes. And they thank Solie for bringing him back into their lives….

The guardianship process could take months. Solie wishes it would move faster.

“Three weeks later he’s still on the street, and the wheels of red tape are moving slowly to get him the help he needs. That’s frustrating,” he said….

Soft on Crime: Criminal out on Streets Doing it Again

HNN: … Authorities said they arrested William Sullivan in Mountain View after paramedics were called to treat him after a crash.

Police said the 29-year-old admitted he owns the firearm and stun gun. However, in court Friday, he pleaded not guilty.

In 2019, Sullivan was a wanted fugitive who faced numerous charges including assaulting an officer, reckless endangerment and resisting arrest.

Advocates braced for evictions when Hawaii’s moratorium ended. The wave never came.

HNN: … The Mediation Center of the Pacific said they were expecting thousands of cases. Instead, they’re only dealing with a few hundred….

“What we’re hearing anecdotally is a lot of tenants are just moving out,” Wiltgen said. “As soon as they realize that there was no moratorium in place, and they weren’t going to be able to pay, they moved out. In some instances, the landlords went to them and asked them to move out.”

Wiltgen said many aren’t aware that evictions have a lengthy legal process, and tenants always have an option to go to mediation. Instead, people think that there is no choice but to move out….

School’s harsh punishment of star student on Maui turns into test of free speech

HNN: … After several months of planning, Lolesio said two days before homecoming, LHS Principal Jeri Dean threatened to cancel the big event because of unclear COVID guidelines.

“I went on social media and I voiced my opinion just because I was really frustrated with the way she was handling things,” Lolesio said.

Lolesio’s Instagram post said that she was unqualified for her job.

As a result, Lolesio was suspended for 10 days, kicked off student council, kicked off the Homecoming Court, and banned from the event.

The principal claimed it was cyberbullying, which is a Class A offense in the Department of Education.

“Having been given a suspension for Class A cyberbullying, that could be something that could be detrimental to his future, going on to college and applying for scholarships,” Tonata said.

But Attorney Kristin Coccaro says Lolesio’s post was merely an opinion.

“The Lolesios and I agree, not a respectful post … but really nothing more than an opinion,” Coccaro said. “The disciplinary action that occurred as a result of that post was just over the top and it was not correct according to the DOE protocols and rules, nor was it constitutional.”….
