Akaka Bill: Aiona still concerned about Abercrombie’s new version

I share valid concerns with the 2010 Akaka Bill, including its limited definition of whom qualifies to be recognized as a member of the Native Hawaiian community; its ill-defined relationship between the Native Hawaiian governing entity and local, state and federal government; and its immediate establishment of sovereignty prior to further negotiations that could address outstanding issues like public safety, healthcare and property rights.

To achieve the type of broad-based support that this landmark legislation deserves, the amendments contained within the 2010 Akaka Bill should be fully vetted and resolved in the community through open and inclusive public hearings.

As an attorney and former state judge, I recognize that opponents of the 2010 Akaka Bill have rightly pointed out that failure to properly address these issues beforehand will likely result in difficult negotiations and protracted litigation following passage.

While my preference is for Congressional leaders to work out these issues before passing the 2010 Akaka Bill, I will continue to support the bill with reservations and work immediately to address any outstanding issues if elected Governor.

When the Advertiser in 2004 exposed business dealings between then-State Sheriff John Sousa and two convicted felons, Souza said he was considering resigning and acknowledged "The appearance is bad." Souza had extended $25,000 credit to organized crime figure Jonnaven Monalim as part of a deal to sell seven Makaha acres of former Hanabusa family property. Another convicted felon was managing Souza's Pueo Trucking company while Souza was Sheriff.

But just two years later, Hanabusa's husband Souza would form a close working relationship with one George Grace III.  Unlike Monalim, a search of the Hawaii criminal database indicates that George Grace III has never been convicted of a crime. But the controversial owner of porta-potty rental firm Paradise Lua has had a court-documented interest in stolen trucks going back to the 1990s.

Meheula’s memo says: “In the late 1990s, when Ed Case was chairman of the State House Committee on Hawaiian Affairs, he repeatedly acted to reduce Native Hawaiian benefits, rights and revenues…. In the 1998 legislative session, Mr. Case proposed the 123-page ‘Native Hawaiian Autonomy Act.’ The Act would have terminated OHA and the Hawaiian Home Lands program, denied Native Hawaiians the right to self-determination and federal recognition, and reduced State liabilities to Native Hawaiians. Ed Case's 2006 "felony" vote: Greens vs. Illegals

It is easy to portray the anti-immigration sentiment as coming entirely from the political Right. But the environmentalist Left is also a big part of the anti-immigration effort. Groups such as the Federation for American Immigration Reform (FAIR), a leading anti-immigration group, played a key role in two failed attempts to take over the Sierra Club in 1998 and again in 2004. FAIR and its offshoot, Numbers USA, advocate not only an end to illegal immigration and deportation of all illegals, but also reduced levels of legal immigration....

Hawaii Representatives Neil Abercrombie, D-HI, and Ed Case, D-HI, (first and second Congressional districts, respectively) both voted on December 16 to keep the felony provision in the bill. Case then voted to approve HB 4437 as a whole while Abercrombie voted against it. Case has close ties to the environmentalist Hawaii Nature Conservancy: his sister Suzanne Case is their Executive Director.

Why Hawaii Lost the Superferry

Last year, instead of enacting a law stating that the Supreme Court was wrong, the Legislature adopted special legislation exempting the Superferry pending completion of an environmental impact statement. The Supreme Court’s recent decision correctly struck down that exemption as violating the Hawaii constitutional prohibition against legislative special treatment for special interests.

The governor and Legislature were then handed a second opportunity to make the law pono by saying what everyone believed. The Legislature could enact simple language, such as the following which I recommended to the legislative leadership in March 2009, making clear that our environmental laws do not extend to "secondary" impacts:

"Significant effect" does not include or require consideration of “secondary impacts” on the environment that may result from government action. This latter provision is retroactive to enactment of this chapter.

By doing so, the law would state what everyone always believed it meant and the Superferry would have been allowed to continue providing essential transportation to Hawaii's citizens and competition to interisland airlines.

I inquired by email to Councilman Greenwell asking if the now infamous article on Guantanamo detainees was true.  In that email, I indicated that I would circulate his response to the same people.  Well here it is.

Mr. Greenwell opted to reply by phone on July 2.  My initial reaction to the call was “wow" “pleasant surprise”, “approval” and those kinds of feelings. But the pleasure was short lived. After but a few seconds, it changed to disappointment and dismay.

It wasn’t more than two or three sentences into the conversation that he became rude, arrogant, combative and boorish!
