HONOLULU – Governor Linda Lingle has appointed former Maui Public Works Director Charles Jencks to serve as an interim commissioner on the state Land Use Commission (LUC).  Jencks will replace Ransom “Randy” Piltz, who resigned on July 2 to run for Maui County Mayor.  Jencks will complete Piltz’s remaining term, which runs through June 30, 2011.

Xtreme has made some extreme claims for its technology....  As with all new battery technologies, the proof will be in the deployments, with close attention being paid to how long, and for how many cycles of varying depths, the systems can operate before degrading. 

(In other words, Hawaii is being used to ‘prove’ a secret technology which has never been proven anywhere else.  The fact that they chose a place with unanimous unquestioning politico/economic/media support for the project shows that they don’t have much faith in it.)

HONOLULU -- The State Commission on Water Resource Management (Commission) issued its final decision and order in the contested case to set interim instream flow standards for four west Maui streams –Waihe‘e, Waiehu, ‘Iao and Waikapu -- known together as “Na Wai ‘Eha.”

We, the undersigned, call upon those seeking to represent us in public office to sign the Contract from America and by doing so commit to support each of its agenda items, work to bring each agenda item to a vote during the first year, and pledge to advocate on behalf of individual liberty, limited government, and economic freedom....

The Commission’s decision also strongly emphasized responsible management of public trust resources.  The Commission ordered Maui County to begin construction within three years to fix the extremely leaky Waikamoi Flume to eliminate waste and provide a more reliable water source for Upcountry domestic and agricultural uses.  Commissioners stated that Maui County needs to develop alternative water sources, conservation and reclamation for water supplies.  Maui County relies upon stream water for approximately 85 percent of its water needs for the Upcountry system.  Due to long-term drought, this is a precarious position for the people of Maui and the County needs to shift the balance of water supply to more reliable sources that do not come at the expense of Hawaii's resources and downstream users of these same waters.

PA‘IA, MAUI – The State Commission on Water Resource Management will hold a meeting on Tuesday, May 25, in Pa‘ia, Maui, to hear public testimony and decide on a petition to amend the interim instream flow standards for 19 east Maui streams: Waikamoi, Alo, Wahinepe‘e, Puohokamoa, Haipua‘ena, Punalau, Honomanu, Nua‘ailua, ‘Ohi‘a, West Wailuaiki, East Wailuaiki, Kopili‘ula, Puaka‘a, Waiohue, Pa‘akea, Wai‘a‘aka, Kapa‘ula, Hanawi, and Makapipi.

Maui TEA Party will rally out front protesting the proposed tax increase.

A highly funded, Washington, DC lobby organization, Food and Water Watch (FWW), is mounting a frontal attack on Hawaii State policy that supports open ocean mariculture. They have rallied a motley crew of rag tag environmental groups, and paid many of them to attack a growing sector of our economy that is on the verge of showing the world a way to produce seafood that is environmentally responsible.

SB: The Hawaii rally was aimed squarely at state lawmakers—majority Democrats who approved this week an increase in the tax on a barrel of oil. The increase from a nickel to $1.05 per barrel is expected to increase the cost of gas and energy bills….

One candidate, Republican Charles Djou, attended the rally and took the occasion of tax deadline day to launch an appeal for votes....

Conditions are especially bad in Maui County, where people are already waiting three to four months for scheduled appointments – just to get started applying for essential aid.

The majority party Legislators who voted for this bill are trying to preserve an antiquated and inefficient processing system for one reason – it requires lots of government workers to do the job.

Hawaii Legislators want to raise the GE Tax by as much as 25%. They propose to raise the barrel tax on fuel 3000%.  But they refuse to even consider abolishing the BoE and placing the DoE under the direct control of the next Governor.  On April 15, Hawaii voters will have their say at rallies planned for Honolulu, Kahului, Kailua-Kona, Hilo and Lihue.  Here are the details and contact information for each rally.

Governor Aiona, who presented the legislation, signed into law today by Governor Linda Lingle as Act 10, at an event to celebrate the change in law.

Joseph de Veuster, who would later be known as Father Damien of Moloka‘i and Blessed Damien de Veuster, was a Roman Catholic missionary who sacrificed his life in service to those suffering from Hansen’s Disease in Kalaupapa on the Hawaiian island of Moloka‘i.

HONOLULU – In response to Senator Roz Baker's (South and West Maui) decision not to schedule a public hearing for House Bill 2311, veterans from across the state, will be delivering their military decorations ribbons and awards that honor their valor and service to the country out of protest to her tomorrow.   

Veterans will present the ribbons to Chair Baker and her Committee members of the Commerce and Consumer Protection (CPN) on Wednesday, March 24 in room 229 at 10 a.m.  Sen. Baker, who sponsored the clothesline bill last year, has chosen to pass an unenforceable resolution about the flag instead....  

What do Sen Roz Baker and Rep Rida Cabanilla have in common?  They both have employed convicted child molester Leon Rouse.

For months, Mazie Hirono pledged to vote against the Senate version of Obamacare.  For her, Senate Obamacare just wasn’t socialist enough.  Along with 56 other “progressive” members of Congress, she demanded a program with a public option and denounced the Senate bill as a multi-billion dollar giveaway to the insurance companies.

Hirono’s July 30, 2009 letter explained:

“Any bill that does not provide, at a minimum, for a public option with reimbursement rates based on Medicare rates--not negotiated rates—is unacceptable…. (T)his agreement will result in the public, both as insurance purchasers and as taxpayers, paying ever higher rates to insurance companies.  We simply cannot vote for such a proposal.”

Hirono has maintained this position as recently as February 2, but at the last minute, barely noticed by her “progressive” base, Rep Mazie Hirono has changed her mind....

Now, more than ever, we need to bring balance to our nation’s capitol.  For too long, Hawaii residents have been underserved with only “one” viewpoint represented in Congress.  This out-of-balance system has failed our citizens and allowed for policies that have stifled our creativity and economic growth and burdened us with heavy taxes, wasteful, out of control government spending, and inefficient bureaucratic growth.

The people are speaking, but Washington isn’t listening.  That’s why we need new leaders who will listen and provide “common sense” approaches to get our country back on track.  Join me in the “good fight” and allow me the honor to represent you with “a strong voice and presence” in the halls of Congress.

Malulani Foundation offers solutions to the very serious problems faced by HHSC and MMMC. Our community can start fresh, with a new hospital and a new vision for healthcare on Maui.

Dr. Ron Kwon started the process for the original Malulani Group to bring a new hospital to Maui and was not successful. Dr. Kwon was very disappointed, left the island and is now affiliated with a major hospital in Boston.

The goal of Malulani Foundation is to bring a private, full service, state of art, 450 bed teaching hospital to Maui which will provide further needed diversity for economy to Maui and a source of jobs for our Maui people.

Initiatives on the County level have included: Kauai Ohana in 2006-2007 attempting to use the initiative process to defeat high property taxes, Stop Rail activists who won the opportunity to vote on rail, and others who have used initiative for various causes on the Big Island.  Hawaii citizens do not have any statewide initiative and referendum rights. A majority of state citizens do enjoy local initiative and referendum rights. 

An estimated 15,000 Hawaii residents rallied Sunday at the Capitol against passage of House Bill 444 which would enact gay civil unions into law.  They were backed by another 500 protesters gathered at the Wailuku State Building on Maui.

HONOLULU – Duke Aiona today announced five county chairs and co-chairs and 13 regional chairs for his growing campaign. The leadership team will provide grassroots support to mobilize and turn out voters for Duke Aiona in the 2010 gubernatorial election.

Thousands of airline passengers on domestic US flights are using forged IDs to get past TSA screeners and board commercial flights under assumed names.  Just days after the al-Qaeda Panty Bomber tried to blow NW Flight 253 out of the sky, evidence leading to acquittals in a Honolulu illegal alien smuggling case has exposed the US Transportation Safety Administration’s repeated failure to spot phony IDs.

Stroudwater didn't pull punches:  "HHSC is in a financially perilous condition. It received a 'Going Concern' finding as part of its 2008 independent audit report, calling the future financial viability of the organization into question. Its liquidity is at dangerously low levels with barely enough current assets to meet current liabilities. It is far behind in its payments to vendors (80+ days). The age of its facilities and other physical assets are well above national averages. Its future viability is at risk, particularly if the State is unable to provide increasing levels of operating subsidies for HHSC going forward."

Kauai Senator Gary Hooser was an anti-Superferry protester.  A magazine business he owned didn't pay its GE taxes for 11 years.  And when he announced his candidacy for Lieutenant Governor, Hooser's campaign website indicated that the anti-Semitic, Holocaust denier, 9-11 trooother website www.WhatReallyHappened.com was part of Hooser's "regular reading regime." 

With credentials like these, the endorsements Hooser is receiving from Hawaii's so-called environmentalists should be of little surprise.

Editor's Note: On Maui, Kihei Elementary School PTA leaders are working against resistance from the HSTA and the DoE to re-open their school on Furlough Fridays.  Why would the union and bureaucracy oppose this plan?  The best clue is at the end of the letter:

"While the children are in their usual routine the rest of us adults can figure out what to do with the budget."

The DoE and HSTA need to create as much chaos as possible in order to stampede the legislature into raising taxes and raiding special funds.  They are working to stifle any discussion of the massive waste, fraud, and abuse contained within the DoE budget.  By coming up with a way to keep school open on Fridays, the Kihei PTA is getting in the way of this DoE/HSTA political game. 

As volunteer sign wavers arrived, they noticed an angry man shouting at them about “F***ing Republicans!” The man picked up the TEA Party signs that were set up near the sidewalk and started to walk away with them. Hodges, called after the man, repeatedly asking him, “Friend, please bring back those signs – they are private property,” but the man continued storming off. Finally, Hodges called out that he would summon police if the man did not return the signs. The man then turned around, marched up to Hodges still carrying the signs and yelled "I'm gonna kick your a**!!".

Hodges, a former Maui police officer, notified the man that pursuant to Hawaii law, Hodges was placing the man under citizen's arrest for the theft of the signs and the physical threat. The man grew angrier and threw the signs, which are made of heavy wood, at Hodges's feet, cutting Hodges’ right leg through his jeans. Hodges stood by with the man until police arrived, accepted Hodges' citizen's arrest, and took the man to the police station for processing. Police reports were generated against the man for theft in the fourth degree and assault in the third degree.

The HSTA union bosses and the top-heavy DoE brass chose the furloughs as a way to convince us that they are indispensable and to justify raising more taxes, including a 20% jump in state excise taxes. More taxes will only deepen the recession and make things worse.

The union and DoE bosses' strategy is backfiring. More and more parents are asking why we need the DoE and the HSTA when they put union elites and the bureaucracy ahead of the classroom teachers, the parents and the students.

Water pours out of Al Hee's Waimana Enterprises Hydroelectric Plant in Hilo. Oddly, OHA, which Al's brother Sen. Clayton Hee used to serve as a Trustee, is not attempting to claim ownership of this water.

It is the fundamental issue of whether we will enable agriculture to survive in our state by ensuring that farmers have access to adequate water to grow their crops.

I am here to talk about achieving a meaningful, reasonable, and balanced decision by the Water Commission, and to offer caution that the decisions the Commission makes will have profound consequences for the future of Maui and our state as a whole.

The Commission will determine the allocation of stream water to meet a public trust.  Included in that deliberation is the examination of the beneficial uses for the water.  I believe because of its importance, water for agricultural operations should be given the same level of protection as that given to domestic consumption, the protection of traditional and customary Hawaiian rights, and the protection of fish and wildlife to achieve a proper ecological balance.

Crossroads will develop a comprehensive assessment of Maui’s present and anticipated healthcare needs, a comprehensive financial feasibility study and business planning for the proposed medical development at a site in Kihei.

• It takes more than four times as much energy to manufacture a paper bag as it does to manufacture a plastic bag.
• Paper sacks generate 70% more air and 50 times more water pollutants than plastic bags.
• It takes 91% less energy to recycle a pound of plastic than it takes to recycle a pound of paper.

One more thing: "In California, bag manufacturers successfully sued Oakland and Manhattan Beach after those cities banned plastic bags. The bag makers complained that officials didn't prepare a report detailing the environmental impact, such as the increased use of paper sacks."  

Ellen Bellerose rushed to Maui Memorial Medical Center's emergency room at her cardiologist's direction after she felt severe pain and pressure in her neck, chest and arms. As the pain intensified over the next two hours, she walked up to the counter three times to report difficulty breathing. She was told there were no beds available. "I was becoming terrified that I could die, unattended, in the emergency room." Although registered as a patient for 27 hours, she never entered the main hospital that February 7, 2006, but was billed as if she had.

Baisa's motion is not mere symbolism.  Section Nine of the proposed ordinance reads:

"The transition of the County of Maui from the jurisdiction of the United States to the reinstated Kingdom of Hawaii will occur over a term of four years, having commenced on February 1, 2009.  All county officials and employees shall retain their positions during this transition period."

Hodges is asking the state and the unions to waive contract terms and regulations that may prohibit furloughed teachers from returning to work under private contract and to streamline approval processes so community volunteers can be mobilized quickly and effectively.

The Democrats’ electoral strategy for 2010 is an attempt to manufacture chaos knowing it is Lingle who “needs to make the tough call."  Their goal: to replicate the labor-management strife of the Cayetano era—and blame Lingle--so a Democrat can re-take the Governor’s seat in 2010.  Their playthings?  Government employee jobs--and your wallet.

Pres. Barack Obama has argued that “one of the best ways to bring down costs, provide more choices, and assure quality is a public option that will force the insurance companies to compete and keep them honest.” But if you want to know how state enterprises really feel about competition, take a look at Obama’s home state of Hawaii.

Originally published July, 2007, this article outlines the effect of government-controlled health care on Hawaii.  Since Hawaii's system has been pointed to as a model for socialized health care, other Americans may be interested to learn the fate which awaits them.

In the wake of a heated fight over construction of a privately funded hospital on Maui, the Hawaii Health Services Corporation (HHSC) is moving to improve its facilities by agreeing to provide Hawaii patients with equipment available in some African hospitals....

Last year, instead of enacting a law stating that the Supreme Court was wrong, the Legislature adopted special legislation exempting the Superferry pending completion of an environmental impact statement. The Supreme Court’s recent decision correctly struck down that exemption as violating the Hawaii constitutional prohibition against legislative special treatment for special interests.

The governor and Legislature were then handed a second opportunity to make the law pono by saying what everyone believed. The Legislature could enact simple language, such as the following which I recommended to the legislative leadership in March 2009, making clear that our environmental laws do not extend to "secondary" impacts:

"Significant effect" does not include or require consideration of “secondary impacts” on the environment that may result from government action. This latter provision is retroactive to enactment of this chapter.

By doing so, the law would state what everyone always believed it meant and the Superferry would have been allowed to continue providing essential transportation to Hawaii's citizens and competition to interisland airlines.

When this subject came up last week in the House Judiciary Committee, an amendment to the hate crimes bill that would have excluded pedophilia from the definition of sexual orientation was defeated by Democrats along party lines, 13-10.

Rep Joe Bertram’s 30-year friend Mark Marcantonio isn’t the only convicted child molester helped out by the Maui Democrat. The Legislative staff directory for 2007 shows that Bertram hired convicted child molester Leon Rouse as a Legislative Aide for the 2007 Legislative session.

Joe Bertram believes sexual predators are clogging up our prisons and should be out of jail, free to lure more of our innocent children. I believe they belong behind bars and away from our communities.  Bertram’s actions are not only disgusting, they are dangerous.

Douglas Suhm from Tacoma, Washington and Dr. David Teuscher from Texas were in Oahu testifying about tort reform and Senators Baker and Ige were disrespectful enough to stand up and walk out of the room.

I’ve seen some bad politicians. But State Representative Joe Bertram stands out. Just last week, Bertram went to court to help a child predator avoid prison-time. A 52 year old man tried to lure a 14-year old girl over the Internet for sex. And Bertram didn’t think he should go to jail. That hits close to home… Polly was 12 when she was killed. As she was kidnapped from her room, she asked her killer to please not hurt her mom. In the worst moment, my brave little daughter thought of protecting others. Shouldn’t we expect the same from our elected officials?

State Rep. Joe Bertram III urged leniency Wednesday for a Makawao man who was sentenced for using the Internet to arrange sexual contact with someone he thought was a 14-year-old girl, saying the defendant shouldn't be sent to prison for an "imaginary crime." ...

"He showed up at the Maui Mall that day," Martin said. "To him, this was not imaginary. This was real." In an October 2007 online chat, Marcantonio talked about how "he had done this before" with a 15-year-old Oahu girl, Martin said.

San Francisco State University:  "[T]he College Republicans must be punished or sanctioned for throwing shoes at the Hamas flag; pending charges should be dropped against the two protestors who assaulted the College Republicans and seized the Hamas flag; and, most ominously for defenders of free _expression on campus, a forum should be created to 'educate' students about what forms of speech the 'offended' students deem acceptable or unacceptable, including what the Left regularly tries to proscribe as 'hate speech.'"

Kimo Apana, a former Maui County Mayor, testified that he brought a friend into MMMC with a stroke this week and although they needed to admit the friend, there was not a bed....

The bill was drafted as a compromise to get House approval and to encourage talks with the state Senate, where many senators are opposed.

There is a parallel universe which comes together every Sunday from 9-10AM in Wailuku Maui at the Cameron Center—conveniently located next to the Maui PD. In this universe—for a hefty fee--the gullible can believe they make their credit card bills disappear. They don’t have to pay property taxes. A phony $1 million “Hawaiian Kingdom Treasury Bond” --paid for with a few thousand real US dollars-- can be used to pay off their mortgage.

This scam is tied to several well-known sovereignty activists—which perhaps explains why the Advertiser’s two recent articles have included so little information about the alleged perpetrators.

Molokai’s largest private employer is closing operations. With unemployment already at 7 percent, 120 more Molokai residents (on an island of just over 7,000 residents) are losing their jobs. In a state where politicians pretend to be obsessed with “saving agriculture,” cattle ranching will end on the 1/3 of the island owned by Molokai Ranch.

After nationalizing a Kauai poi factory in December, the state of Hawaii is considering collectivized agriculture. A bill before the Legislature’s House Committee on Health would establish a state farm on Maui -- to grow marijuana.
