Prosecutors Win on Appeal -- Maui Hate Criminals to get more time in prison after beating white man with a shovel

NYP: … A native Hawaiian man serving time for brutally beating a white man with a shovel over a decade ago will be resentenced and could be hit with additional years in prison after his appeal of his hate crime conviction was rejected.

Kaulana Alo-Kaonohi, 35, was originally sentenced to six-and-a-half years by a Honolulu judge alongside Levi Aki Jr, another Native Hawaiian man, after a jury found them both guilty of the hate-fueled violence in 2023.

The court determined that the duo were motivated by Christopher Kunzelman’s race when they repeatedly beat him with a shovel in 2014 when he and his wife tried to move into their remote village in Maui….

Kunzelman was left with severe brain damage following the assault that placed such stress on his marriage that it catalyzed a divorce, his wife Lori said….

Alo-Kaonohi tried to appeal the conviction, taking issue with the federal hate crime enhancement, but the 9th US Circuit Court of Appeals affirmed his conviction Thursday.

…three extra years could feasibly be tacked on.  Lori Kunzelman said she’d welcome the extended sentence after she and her husband were essentially run out of their dream home before even moving in.

… The Hawaii Innocence Project plans on contesting the retrial to prove that “haole” is not a derogatory term, the organization’s co-director Kenneth Lawson said…

Lahaina Strong Helping Trump Abolish FEMA--Administration Pretends to Take Mrs Kaniela Ing’s Sex-for-Food Stories Seriously

CB: … While presiding over a FEMA Review Council meeting on Wednesday, Homeland Security Secretary Kristi Noem cited an eyebrow-raising statistic: 1 in 6 survivors of the deadly 2023 Lahaina wildfire on Maui exchanged sexual favors for basic supplies.

(CLUE: When the left relies on airheads and meth dealers, the result is inevitable.  And they have learned nothing from this latest episode.)

The data point was in sync with a Trump administration threat to abolish the federal agency responsible for coordinating a national response to major disasters. President Donald Trump, a vocal critic of the Federal Emergency Management Agency, has said he plans to shift disaster management to states after this year’s hurricane season….

(CLUE: This is a story about the meth-connected Lahaina Strong group, and Mr and Mrs Kaniela Ing.)

The study says 16% of the survey participants, or 11 people, reported that they engaged in sexual activity with a landlord, employer, family member, friend or acquaintance in the aftermath of the wildfire in exchange for food, clothing, money or shelter. That activity is defined broadly — kissing, hugging and touching as well as sexual intercourse.

That the experiences of those 11 Filipina women became an unexpected political flash point baffled not just Lahaina wildfire survivors and those involved in the ongoing disaster relief effort on Maui, but data experts and even the organization that did the survey.

“This limited sample cannot be generalized to the entire population of wildfire survivors,” said Ruben Juarez, an economics professor at the University of Hawaiʻi Mānoa and the director of a study on the health effects of wildfires on Maui. “It is inaccurate and deeply irresponsible to imply that 1 in 6 people across Lahaina experienced this form of exploitation.”

(Airhead) Khara Jabola-Carolus, (aka Mrs Kaniela Ing) a co-author of the (misleading) report, also condemned Noem’s use of the sexual exploitation statistic as (being) misleading (about my misleading). The report, published in May, was meant to shine a light on gender inequity experienced by a vulnerable group of immigrant women during the Lahaina wildfire disaster response. It was never intended to represent the experiences of all Lahaina fire survivors.

Moszkowicz Forced out as Big Island Chief (now he can try for HPD Chief)

CB: … Moszkowicz said he submitted his resignation prematurely by email to Hawaiʻi Police Commission Chair Rick Robinson on June 4. Moszkowicz was in Orlando at the time, attending an FBI training. 

He choked up as he explained to commissioners in Hilo on Thursday that he immediately realized he’d made a mistake. 

“In a few hours I said, ‘After further consideration, I would like to withdraw my resignation,’” he said, taking a pause to hold back tears. 

The eight-member police commission was tied with four members voting to let Mosckowicz withdraw his resignation and four voting against. But Chair Rick Robinson said the tie vote was not enough for the motion to move forward. 

“I’m sorry, chief,” he said to Mosckowicz after the vote was taken.

Even after requesting to rescind his resignation, Moszkowicz appeared at a Honolulu Police Commission meeting via video conference on June 18 to express interest in the interim chief position. He told commissioners there that if chosen, he would be “aggressively competing” for the permanent job.

After briefly interviewing eight candidates, commissioners selected Honolulu Police Deputy Chief Rade Vanic to serve as interim when Logan retires at the end of July. 

On June 26, Moszkowicz issued an apology to the Big Island community. He said his decision to resign was “premature” and reiterated his commitment to the county. …

HTH: Moszkowicz out as Big Island police chief - Hawaii Tribune-Herald -- Moszkowicz told commissioners he has enough remaining vacation time to clear out of his office on Tuesday and return on Aug. 31 to turn in gear issued to him that belongs to the department.  Deputy Chief Reed Mahuna will become acting chief on July 16. The police commission can appoint an interim chief once Moszkowicz has retired.

Blangiardi Blindsided by Rade Vanic’s Interest in Top Job

HNN: … “We didn’t think we got ahead of the game,” Blangiardi said. “Most people don’t understand what’s the circumstance, and let me just tell you then what the circumstance was. I fully understood that according to the (city) charter that the next person in line would be the deputy chief.”

The problem was, according to the mayor, Honolulu’s two deputy chiefs seemed unlikely to fill the role.

He said, “Keith Horikawa, I knew, had no interest, nor did he even apply to be the interim chief. So I was correct in that assumption, if you will. Chief (Rade) Vanic had been out on sick leave for six months, not even scheduled to come back until July.”

So, Blangiardi said, he thought of Moszkowicz, with whom he’d had conversations with in the past.

“I thought this was an opportunity, in a situation where we didn’t have anybody readily available, to bring back a man who had a very distinguished career, not only in the 22 years at HPD, but the two and a half years as chief on the Big Island, who is willing to come back to the department that he had served so for so long and so well, understanding full well, I can promise you this was witnessed, there were no guarantees about anything,” Blangiardi said.

“We didn’t get ahead of ourselves. I was acting in the best interest of HPD in providing qualified leadership at that time according to the charter and the circumstances I was dealt,” Blangiardi said.

The mayor said he apologized to Moszkowicz following the commission’s vote Thursday.

“I don’t like what happened to Chief Moszkowicz. I’ll say it again. I had no control over that. I wish it hadn’t happened. If I could prevent it, I would have,” Blangiardi said.

“This man has had a distinguished career. He deserves better than he got,” he said. “I have the greatest respect and admiration for him, as do many of the people who know him. He’s a qualified police officer who has given the last 25 years of his life to protect and serve. That should not be forgotten in this moment. And that’s why I feel so bad for him.” …

Lawmakers' Plan To Give $50M To Nonprofits May Be Unconstitutional

CB: … The new law creating a unique committee to pass out up to $50 million in extra aid to Hawaiʻi nonprofit organizations this year has triggered a warning letter from a public interest law firm saying the plan would be vulnerable to legal challenges.

The letter from the Public First Law Center cites “procedural defects” in the passage of Senate Bill 933 this spring.

The problem is the text of the measure was added to a “short-form” bill too late in the legislative session, and the law center’s executive director Brian Black said in an interview it missed a key deadline for bill introduction set out in the state constitution.

“Because of this defect, the law may be challenged as unconstitutional and nullified, jeopardizing any grants made by the committee,” the letter states….
