HNN: … Though Fevella missed the official deadline to file a challenge with the high court, he filed a motion anyway. In the filing, Fevella apologized for the delay, explaining that the situation is “new territory” for him.

On Friday, the Hawaii Supreme Court officially ordered a new election for State Representative District 43, another tied Republican primary.

In the Senate District 20 Republican primary, former lawmaker Bob McDermott and incumbent state Sen. Kurt Fevella finished tied with exactly 1,212 votes each.

There is no word yet on whether the Supreme Court will agree to hear his case….

Why Maui police don’t always name people who are arrested, including their own officers 

MN: … It’s a policy the Maui Police Department adopted in 2024 after Arizona resident Brian Houston sued the Maricopa County sheriff’s department over the publication of his mug shot with identifying information that included his name, date of birth and other personal details such as his height and weight.

Charges were later dropped against him, but Houston said his reputation had already been damaged and his mug shot had been picked up by third-party websites. 

In September 2024, the U.S. 9th Circuit Court of Appeals, which covers Hawai‘i and the West Coast, ruled that the publication of mug shots on government websites was unconstitutional and essentially amounted to “pretrial punishment.” 

The unanimous ruling of the three judge panel opened the door for Houston and others to sue the law enforcement agency….

Maui Council panel advances license plate reader bill, delays facial recognition technology measure

MN: … Maui County Council members voted 7-1 in committee Thursday to put safeguards on how local law enforcement uses automated license plate reader technology, but they deferred action on a second bill addressing facial recognition technology that is not yet deployed by the Maui Police Department.

The action by the Disaster Recovery, International Affairs and Planning Committee, chaired by Council Member Tamara Paltin, came a day after dozens of Maui residents urged council members to ban or sharply restrict police use of facial recognition and license plate reader technology, maintaining that two bills meant to regulate the tools don’t go far enough and that unregulated camera networks are already watching island residents.

The committee’s vote came with a single dissent from Council Member Gabe Johnson. Council Member Yuki Lei Sugimura was absent and excused.

On Wednesday, the committee spent two-and-a-half hours hearing public testimony on Bill 112 and Bill 113 before recessing without taking action. Of the dozen people who testified, nearly all opposed the bills as written, with several calling for the county to ban the technologies outright rather than regulate their use….

Laughing 33-time loser gets only 5 years for hit-and-run death of lifeguard

KN: … Before sentencing, Kailon’s father, Vaughan E. Tyndzik, was the first to testify before Soong. The situation suddenly turned tense, prompting the court to take a recess after Vaughan E. Tyndzik asked Hilario to look him in the face, and Hilario laughed.

Vaughan E. Tyndzik then yelled, approached Hilario, threatened him, and stared him down while Hilario was escorted out of court….

Hilario’s court records reveal an extensive criminal traffic record dating to 1993 and encompassing approximately 33 arrests, ranging from traffic infractions to serious traffic offenses.

Police said he had no permanent address at the time of his arrest….

Vaughan E. Tyndzik told Kauaʻi Now, outside of court, that the judgeʻs 5-year decision was a “disgrace.”

“That man ran over my kid, he said. “The guy’s got a history as long as my arm and never will become anything and doesn’t want to become anything, not even a better person from this.

“He laughed when I asked him to look at me in the face. He has no respect. The judge mentioned he got no respect from day one, but he gets five years on a plea bargain. To me, it’s a disgrace.”

Williams also addressed the court and said the family and community had strongly opposed the plea agreement.

She said she had worked in prevention and recidivism programs for 19 years and argued that Hilario posed a continuing danger to the community.

“He will not change. He will reoffend. This man will hurt again,” Williams said….

Pearl City poke shop owner allegedly sold kilos of cocaine

SA: … The owner of a Pearl City poke restaurant is facing a federal criminal charge after he allegedly admitted to DEA agents that he had been marketing kilograms of cocaine since 2020.

Kevin Dean Ikaika Dolor-Spillner, 37, is scheduled to make his initial appearance today in U.S. District Court. He was charged on Sept. 1 with possession with intent to distribute more than 500 grams of cocaine. Dolor-Spilner owns Poke on the Run in Pearl City, using his holding companies JKL Spillner LLC and Eternal Loyalty LLC, according to state business records.

The popular Pearl City poke spot on Lehua Ave. was praised for its fish, ahi katsu, braised beef and other local favorites….
