Rescissions Bill; IRS Confirmation

The House passed a few bills this week including a rules resolution that fixed a problem in the drafting of the House's version of the reconciliation bill (rules resolution; resolution fixing the drafting error). The Senate confirmed several nominees including former Rep. Billy Long to be Commissioner of the IRS.

House

Most of these bills are still early in the legislative process and still need to pass in the Senate, but the first bill has now passed both chambers and will become law.

S. 331: HALT Fentanyl Act passed 321-104. It goes to the President next for signing.

H.R. 2966: American Entrepreneurs First Act of 2025, which would require proof of citizenship for certain Small Business Administration loans, passed 217-190

H.R. 2035: American Cargo for American Ships Act which would require that any cargo of the Department of Transportation be shipped on US-owned ships, passed 373-14

The next three bills override local preferences of the residents of the District of Columbia. This is possible because while the District has a government and can vote on locally applicable issues, it's still federal land and Congress can override them.

H.R. 2056: District of Columbia Federal Immigration Compliance Act of 2025, which would direct the Washington, D.C. government to comply with requests from federal immigration authorities to share information and detain non-U.S. nationals (per CBO) passed 224-194. Currently, D.C. law requires a judicial warrant before the District officials would cooperate with federal immigration authorities.

H.R. 2096: Protecting Our Nation’s Capital Emergency Act which would, according to CBO, modify Washington, D.C.’s police disciplinary procedures by (1) striking a provision that prohibits collective bargaining on matters of police discipline, and (2) affecting the statute of limitations for when members of the public can bring claims against the DC Police Department, passed 235-178

H.R. 884: To prohibit individuals who are not citizens of the United States from voting in elections in the District of Columbia and to repeal the Local Resident Voting Rights Amendment Act of 2022 passed 266-148

The Rescissions Bill. We wrote about what rescissions are several weeks ago anticipating that this bill would be up for a vote a bit sooner than turned out to be the case. This is, in short, the definitely legal way to cut funding that has already been appropriated and it's notable that it's only now, in mid-June, that the administration is trying it after five months of legally dubious unilateral action, nearly all of which is working through the courts.

H.R. 4: Rescissions Act of 2025, which would cut some or all funding from USAID, the Corporation for Public Broadcasting and other State Department programs, passed 214-212

Long, Commissioner of the Internal Revenue Service was confirmed 53-44 by the Senate despite a history of aggressively marketing fraudulent tax credits.
