
Hawaiʻi received an overall grade of “F” and ranked 48th in the nation in Children’s Rights Across the States: A 50 State Report Card, a national report released by Them Before Us, an organization focused on advocating for children’s rights in family policy.
The report evaluated how state laws protect a child’s right to their mother and father and rated Hawaiʻi “Very Poor” in both parentage and surrogacy laws.
According to the report, Hawaiʻi’s new Uniform Parentage Act replaced “mother” and “father” language with gender-neutral terminology, allows parentage to be established based on “intent,” and permits more than two adults to be legally recognized as parents.
The report also states that Hawaiʻi now permits both gestational and genetic commercial surrogacy arrangements and grants legal parentage to unrelated “intended parents” in donor conception cases, even when the birth certificate does not reflect the child’s biological parentage.
Hawaiʻi received a total score of 6 points, placing it among the lowest-ranked states in the country.
The report concludes that these legal trends increasingly prioritize adult desires over children’s rights and family stability.
