Maui Voter Roll Lawsuit Settled, Kauai Suit Continues

Hawaii Voter Roll Maintenance Challenge (PILF v. Lutey)

from Democracy Docket, Aug 7, 2026

The Public Interest Legal Foundation (PILF) is suing the county clerks of Maui and Kauaʻi, alleging that the counties violated the National Voter Registration Act (NVRA) by failing to maintain and disclose records related to their voter list maintenance activities.

In February, PILF requested records concerning the counties’ voter list maintenance procedures and alleges that the counties failed to adequately produce the requested records. PILF argues that Maui and Kauaʻi violated the NVRA by failing to retain the records for at least two years and by refusing to make them available for public inspection.

PILF is asking the court to order the counties to produce the requested records and to require them to maintain such records for at least two years.

This lawsuit is the latest in a series of PILF cases seeking to pressure states and local governments to more aggressively purge voters from registration rolls under the NVRA.

UPDATE: PILF 'Wins' Maui Agreement to Release Voting Records

News Release from Public Interest Legal Foundation, October 08th, 2026

ALEXANDRIA, VA (October 8, 2026) – The Public Interest Legal Foundation (PILF) has won a settlement with County Clerk of Maui Moana Lutey after she initially failed to provide requested voter list maintenance records under the National Voting Rights Act of 1993 (NVRA).

Clerk Lutey has now produced the list maintenance records that were requested under the NVRA.

“This settlement is a victory for Maui voters,” said Amanda Fischer, PILF’s communications director. “Federal law requires public access to voter registration list maintenance and cancellation records. This outcome will help ensure Maui’s voter lists are accurate.”

PILF has reached similar settlements in New Mexico, Arizona, and Oregon. Read more about PILF v. Lutey here.

PILF attorneys for this case were Joe Nixon and Sam Swanson.

The Public Interest Legal Foundation (PILF) is the nation’s only public interest law firm dedicated wholly to election integrity. The Foundation exists to assist states and others to aid the cause of election integrity and fight against lawlessness in American elections. Drawing on numerous experts in the field, PILF seeks to protect the right to vote and preserve the Constitutional framework of American elections.
