HAWAII CCW UPDATE: SENSITIVE-PLACE RESTRICTIONS CAN NOW BE ENFORCED

Today, August 10, the Ninth Circuit issued its new opinion in Wolford v. Lopez following the case’s return from the U.S. Supreme Court.
As a result, the preliminary injunction that had prevented Hawaii from enforcing portions of its sensitive-place law has been removed.
CCW holders can no longer legally carry under that injunction in: bars, restaurants serving alcohol, beaches, parks, playgrounds, state and county recreational facilities, and exclusive parking areas adjacent to those locations.
The injunction remains in effect for banks and financial institutions, bank parking areas, certain shared/nonexclusive government parking lots, and Hawaii’s private-property default rule.
This is an important change for Hawaii CCW holders. Places where enforcement had previously been blocked by the federal injunction can now once again be enforced as sensitive places under Hawaii law.
